New Vaping Laws from July 1
New legislation has been passed to end the retail supply of vapes. From 1 July 2024, vaping products will only be available from pharmacies. The vapes will be subject to quality and product standards (e.g. plain packaging, maximum nicotine concentration levels, limited to mint/menthol and tobacco flavours).
The vaping reforms are not as stringent as originally intended – adults who wish to use a vape for therapeutic purposes will no longer require a medical prescription from 1 October 2024. However, the reforms still represent significant progress towards protecting Australians from the harms of nicotine addiction and the tobacco industry.
Under the new laws:
- the way Australians can access vapes has changed
- vapes can only be sold in pharmacies, regardless of whether they have nicotine in them or not
- non-pharmacy retailers, such as tobacconists, vape shops and convenience stores, cannot sell any type of vape
- flavours in vapes are restricted to mint, menthol and tobacco
- there is a ban on the advertising or promotion of vapes.
